Northern California trademark attorneys Brooke Oliver and Lyndsey Heaton have been recognized as top global trademark attorneys, named to the 2026 World Trademark Review (WTR) 1000 list. Brooke is a nationally recognized art and entertainment attorney with more than 30 years of experience advocating for artists, nonprofits, and social justice causes. Lyndsey is an accomplished litigator who represents companies and business owners in high stakes intellectual property and complex commercial disputes, with a practice centered on protecting brands, technology, and competitive advantage. Both are based in Procopio’s Silicon Valley office and are active members of Procopio’s Trademarks and Copyrights practice.
According to WTR, the WTR 1000 identifies the leading professionals and firms that are deemed outstanding at obtaining, protecting, managing, enforcing and monetizing trademarks. WTR undertakes exhaustive qualitative research, identifying top firms and individuals based on their depth of expertise, market presence and sophistication of work. To research the market, WTR conducts in-person, telephone and video interviews and gathers written submissions from firms detailing their recent activity in the field.
Brooke’s high-profile work includes arguing Dykes on Bikes trademark cases before the U.S. Supreme Court, twice securing historic wins for LGBTQ+ rights. She also led the legal strategy behind Burning Man’s transition to nonprofit status and negotiated precedent-setting VARA settlements, including the restoration of Judy Baca’s iconic Hitting the Wall mural. A leading authority on the Visual Artists Rights Act, Brooke has been called “a folk hero of copyright law” for her groundbreaking victories on behalf of visual artists. Bilingual in Spanish and deeply rooted in community activism, she and her wife co-founded Que Viva!, a Burning Man theme camp that unites artists and changemakers. Her leadership has been formally recognized by the City of San Francisco and the California State Senate. Brooke has advised cultural and advocacy organizations such as the Dolores Huerta Foundation, San Francisco Pride, and the SF Gay Men’s Chorus. Earlier in her career she spent seven years with an angel investor. Brooke has previously been recognized for Intellectual Property Law by Super Lawyers, and has received the Teddy Witherington Award for Outstanding Service to the LGBT Movement and the Cesar E. Chávez Legacy Award.
Lyndsey litigates matters involving trade secrets, trademarks, copyright, patents, counterfeiting, unfair competition, employee fraud, and intellectual property theft, and she regularly advises clients on practical, effective enforcement strategies to stop infringement and misuse before it escalates. She works with clients across a wide range of industries, including enterprise and networking technology, consumer electronics, wearable technology, internet service providers, textile and industrial manufacturing, securities, and financial payments technology. She handles cases from first filing through appeal. Lyndsey has tried bench and jury cases in both state and federal courts in California and New York and has handled appeals before the Ninth and Second Circuits. In addition to intellectual property litigation, she prosecutes and defends complex commercial cases involving high exposure and sophisticated legal issues. She was also named to the WTR Trademark 1000 list in 2025.
Procopio attorneys and practice groups are routinely named to various legal rankings lists, including Chambers and Partners, Best Lawyers, Best Law Firms, Super Lawyers, IAM, WIPR, and Martindale-Hubbell.
