
Procopio and two of its Partners have been recognized for trade secret litigation by World Intellectual Property Review (WIPR) in its 2025 USA Trade Secrets Rankings. Mindy Morton made WIPR’s “Recommended” list and Ben Herbert its “Notable,” list, with Procopio also listed as a “Notable” firm. This is the second straight year WIPR has recognized Procopio as well as Mindy and Ben, in only the publication’s second year of compiling these rankings. Mindy was also named last year to the 2025 WIPR Global Trade Secrets list.
Mindy focuses on intellectual property, data privacy, internet, and healthcare litigation. She helps companies from funded start-ups to public companies handle trade secret, privacy, copyright, trademark, patent, and complex commercial disputes. Mindy frequently assists with complex commercial litigation involving software contracts, intellectual property licenses, and non-compete agreements. In addition to managing litigation involving all matters of IP, Mindy serves as a senior editor for Sedona Conference’s Working Group 12 on trade secrets and chairs the ABA IP Section’s Trade Secrets Committee. She leads Procopio’s Trade Secrets practice group and is based in Procopio’s Silicon Valley office.
Ben focuses on trade secret misappropriation and patent infringement litigation. He has led multi-district patent litigation campaigns, successfully led early settlement negotiations in trade secret and patent litigations, and has experience evaluating potential disputes and determining litigation strategy. He has litigated complex patent and trade secret cases involving diverse technologies, including digital radios, medical devices, consumer products, computer software and hardware, graphics processors, bitcoin mining, portable power generation, and satellite technology. He also serves on Sedona Conference’s Working Group 12 on trade secrets. Ben joined Procopio’s Orange County office in December 2025, selecting Procopio in part due to its robust trade secret practice.
