
Irvine/Los Angeles, CA (January 8, 2026) – Award-winning intellectual property litigator Benjamin Herbert has joined Procopio as a partner in its growing Litigation Team. Ben brings significant experience in patent and trade secret litigation across a wide range of advanced technologies to an IP Litigation practice with a deep bench of seasoned litigators. Based in Procopio’s Irvine, California, office, he joins Procopio from the Los Angeles office of Miller Barondess, where he was the co-leader of the firm’s intellectual property practice.

Ben has represented technology companies in federal courts, in appeals before the U.S. Court of Appeals for the Federal Circuit, and in proceedings before the U.S. Patent and Trademark Office. His work spans digital communications, semiconductor architecture, medical devices, and other complex systems. He also advises clients on strategic patent issues and licensing.

Among his courtroom accomplishments, he served as lead counsel for a health tech company in litigation across the U.S. concerning percussive massage devices and helped secure a $30-million jury verdict for a provider of predictive online customer service technology regarding patent infringement and trade secret misappropriation, among other torts.
Ben has earned significant third-party recognition. He has been recognized by Best Lawyers® as a One to Watch in both Patent Law and Patent Litigation. He was also named to the IAM Strategy 300 list for 2025, and WIPR recognized him as a Notable US attorney in its 2024 Trade Secrets Rankings. Ben earned his J.D. summa cum laude from Arizona State University’s Sandra Day O’Connor College of Law and holds a bachelor’s degree in molecular cellular developmental biology from the University of Colorado.
