The California Attorney General is concerned that the pandemic creates a consumer privacy environment that is ripe for data breaches, and it may be difficult to use COVID-19 as an excuse for non-compliance. How companies implement data privacy programs and security plans including incident response plans for data breaches, hold an important key to whether they will be able to effectively defend privacy litigation and class action lawsuits. There have already been numerous lawsuits testing the waters under the new CCPA and more companies will inevitably face significant lawsuit risks and crippling data breaches in the near future.
