San Diego, CA
– Tyrone Allen died yesterday at Scripps Mercy Hospital after more than five months of intense suffering. On August 28, 2008, Mr. Allen and his wife were making their way through a pedestrian walkway on the outside perimeter of a construction project at 15th and Imperial Streets in downtown San Diego's East Village when the walkway collapsed on top of him. The devastating collapse was captured on video by a security camera. Shortly before the collapse, construction workers can be seen on video unloading steel scaffolding from a truck and leaning it against the walkway. Mr. Allen was left a quadriplegic from the collapse because of the massive injury to his neck and spine.
"This was a tragic and absolutely senseless death," said Todd Neal
, the attorney representing Tyrone & Tina Allen. "For more than five months he fought for his life but the injuries he suffered were too severe. He turned 49 last week as a quadriplegic on a respirator in the hospital. His family is devastated by the extraordinary suffering he endured and they are distraught that he is gone forever."
A lawsuit is currently pending and will continue as a wrongful death action.
"We will vigorously pursue fair compensation for his family, but that is for another day,” said Neal. “Today is for remembering that Tyrone was a special person. He was a big hearted man who was deeply loved by his wife, children and brothers and sisters. His family is grieving and asks that their privacy be respected."
