So You Want to Stay Compliant? Here’s What You Need to Know

  • Thinking of Using Independent Contractors? Watch Your Step – Employers in California are finding it increasingly difficult to classify workers as independent contractors rather than employees. The challenges began in 2018 with a state Supreme Court decision (Dynamex) that imposed a narrow test on how an employer can define an independent contractor. A 2019 Ninth Circuit decision found that the test can be applied retroactively. Procopio Partner Tyler Paetkau and Senior Associate Olga Savage will provide the latest word on this critical employment issue.
  • Protecting Your Trade Secrets Post-DTSA – No company wants to lose their competitive edge by having internal secrets go out the door, nor do they want to be accused of stealing a competitor’s trade secrets. The legal landscape has changed since the passage of the federal Defend Trade Secrets Act of 2016. Procopio Partner Mindy Morton shares the latest.
  • Staying On Top of the Latest U.S. Government Export Restrictions – Trade disputes are dominating the headlines, and rocking corporate C-suites. Tangled in those disputes are U.S. government regulations and in some cases prohibitions related to exports. The May restrictions on exporting most technologies to Huawei and related entities is only the latest development. Procopio Partner Miku Mehta shares information every company engaged in the global marketplace needs to know.
  • A New California Privacy Law Goes into Effect in 2020: What You Need to Know Now – The California Consumer Privacy Act (CCPA) has the potential to be a game-changer for any company with customers in California. This sweeping new privacy legislation passed in 2018 but is still being amended. It goes into effect on January 1st, however, so it’s important to stay on top of developments now. Procopio Senior Counsel Elaine Harwell has the latest.
