Aiko Yamakawa counsels charter school clients regarding all aspects of their operation, including incorporation, board training, charter petitions, renewals and revocations, facilities and student privacy issues.  Aiko also advises water and wastewater entities, health care entities and self-insurance joint powers authorities on a variety of issues including public contracting, open meeting laws, public records, conflicts of interests, public finance, insurance coverage and litigation matters.

Prior to joining Procopio, Aiko practiced in the area of public agencies, charter schools and environmental regulation as an associate at Foley & Lardner LLP. She served as a law clerk for the Hon. Ralph Dau and the Hon. Ernest Hiroshige of the Superior Court of California, County of Los Angeles, as well as for the US Attorney for the Southern District of California, Civil Division.

Representative Matters

  • Advised school district regarding $80M facilities construction and modernization bond program including all phases of lease-leaseback construction and validation, professional services agreements and technology procurement.
  • Advised wastewater and recycled water joint powers authority regarding construction of $4M advanced water treatment project, including negotiating and drafting related agreements.
  • Obtained title to real property for wastewater infrastructure project through eminent domain action.
  • Represented school district in a taxpayer action challenging a Proposition 39 bond project and resulting in published opinion, McLeod v. Vista Unified School District (2008) 159 Cal.App.4th 1156.
  • Defended provider against records subpoena involving state law and HIPAA issues.
  • Represented petitioners in charter approval process before school district chartering authority.
  • Drafted employment practices liability coverage language for insurance joint powers authority.
