Proving the separate character of such assets can be a difficult process, especially in cases where the spouses dispute the separate or community character of all or part of their assets. A breach of fiduciary duty can arise in the domestic context in multiple ways, such as failing to disclose assets, purposefully hiding assets, and making careless investments during marriage.
