It is not uncommon for people to enter into marriage with substantial assets, and without a prenuptial agreement.  Many spouses also receive large gifts or inheritances during marriage, but neglect to maintain these funds separate from their community assets. Proving the separate character of such assets can be a difficult process, especially in cases where the spouses dispute the separate or community character of all or part of their assets. Our attorneys are adept at handling complex family law matters involving the tracing, characterization, and distribution of marital property assets with the assistance of forensic accountants and other experts.

Breach of Domestic Fiduciary Duty

A breach of fiduciary duty can arise in the domestic context in multiple ways, such as failing to disclose assets, purposefully hiding assets, and making careless investments during marriage.  Procopio’s attorneys have substantial experience in discovering, exposing and litigating domestic breach of fiduciary duty claims.  In the course of representing clients in high-asset, complex financial structure cases, our attorneys have encountered almost every legal issue that can arise in the context of domestic breach of fiduciary duty litigation.

When Business Becomes Personal

The division of property of divorcing couples may involve the characterization, valuation and division of a business and its assets.
