El Cajon is appealing ruling on land annexation

EL CAJON — The city of El Cajon is appealing a Superior Court judge's decision denying its plan to annex 14 acres just east of the city so a Home Depot store could be built.

The city filed its appeal Wednesday with the 4th District Court of Appeal, said Evelyn Heidelberg, an attorney for El Cajon.

An Orange County Superior Court judge ruled in October that the San Diego Local Agency Formation Commission was correct when it denied El Cajon's request to annex the land. The property, which is owned by The Home Depot, is surrounded by El Cajon on three sides and Interstate 8 on the fourth.

The land must be transferred from the county to the city before building can begin. The proposal angered nearby residents and has pitted the city against the county.

Heidelberg said a decision from the appellate court is not expected for about a year.
