This is the first part of a two-part webinar/seminar series. On October 20, 2011, the California Air Resources Board (CARB) adopted the groundbreaking rule California Cap on Greenhouse Gas Emissions and Market-Based Compliance Mechanisms. The rule, which becomes final next month, will limit greenhouse gas emissions at hundreds of facilities and electricity importers by January 1, 2013. In 2015, the program will also include importers and distributors of natural gas, transportation fuels and other fossil fuels. The economic impacts are expected to be felt in every corner of California where energy is used. Heavy litigation of the rule is expected.

In this webinar, we will cover:
  • What are the applicable covered entities?
  • What are the compliance requirements affecting each covered entity?
  • How and when should you register and set up accounts?
  • How will the allowances be meted out?
  • What are the available compliance instruments and market mechanisms?
  • What is the role of offsets for compliance?

  • What is the uncertainty in the rule, what is left for CARB to develop?

The goal of the webinar is to give you an initial overview of the California GHG rule applicability and requirements. The second part of the series to occur in early 2012 will address more specific compliance strategies by sector.

About the presenters:

John J. Lormon, Esq.
Mr. John Lormon is a Partner with Procopio. Mr. Lormon specializes in environmental, climate change, sustainability, and ecosystems law. He has experience working with local and state government and regulatory agencies on environmental permitting, entitlement and compliance matters. Mr. Lormon has handled project development, permitting, compliance, and enforcement issues.

Mr. Lormon has managed numerous Clean Air Act cases involving stationary and mobile sources. He has special expertise in air emission impacts to local communities. He has worked on carbon emission, diesel and soot projects in large projects in Los Angeles and Long Beach Harbor. He is experienced in water delivery, water treatment, desalination, and purification as well as wastewater and reuse matters.

Mr. Lormon has been active in politics and bond initiatives. He was team leader for Gray Cary Ware & Freidenrich’s (now DLA Piper Rudnick) environmental practice group for eight years before joining Procopio. He was appointed by the Governor to the California
Regional Water Quality Control Board, San Diego Region 9 (1992 to 1996), and to the State Coastal Conservancy Board (1997 to 2004).


James A. Westbrook
James A. Westbrook is the President of BlueScape Environmental, a full-service environmental consulting firm located in Southern California. He specializes in developing cost-effective environmental compliance strategies designed to achieve client business goals. In the past 20 years, Mr. Westbrook has managed or completed more than 30 greenhouse gas-related projects including AB32 and EPA emission inventories, GHG inventory verification, CEQA mitigation, PSD permitting for GHG, voluntary carbon offsetting, and carbon lifecycle. Industries served include refineries, utilities, power plants and electricity marketers, solid waste landfills, dairies, oil & gas production, LNG facilities, and building materials manufacturing. Prior to founding BlueScape in 1997, Mr. Westbrook worked for ENVIRON Corporation and Kleinfelder.
