Mary V.J. Cataldo

Ms. Cataldo's practice emphasizes complex business litigation and trust, estate, and probate litigation. Prior to joining Procopio, Ms. Cataldo was with the firm of Lodge & Heller in Carlsbad, California.

Representative Matters

• Obtained judgment in quiet title action between tenants in common in the amount of $214,246.17
• Assisted in trial resulting in award of over $150,000, plus fees and costs, in connection with action for breach of fiduciary duty, quiet title to bank accounts, misuse of funds, and elder abuse
• Assisted in complex breach of fiduciary duty and surcharge action against trustee, involving extensive recreation of documentary history and accounting information, resulting in judgment in excess of $3 million
• Assisted in complex construction defect and fraud action, requiring analysis and management of twenty years of historical documentation, resulting in settlement and cash payment to plaintiff

Ms. Cataldo received her undergraduate degree, with honors, from the University of Arizona in 1975 and her law degree from Western State University College of Law in 1994. She was admitted to practice law in California in 1994. Ms. Cataldo is an adjunct professor in the areas of civil litigation, torts, and business law at Palomar College, and civil litigation at University of San Diego Paralegal Program. She served as a Director of the North County Bar Association for 2003-2005 and for 2007-2009, and served as President in 2010. She is a member of the San Diego County Bar Association and the American Bar Association. She is President-Elect of the North County Bar Association and is a member of the San Diego County Bar Association and the Lawyers Club of San Diego, North County Chapter.
